Wiltshire Council has successfully defended an appeal against an Enforcement Notice served on the owners and occupiers of Wyatts Lake Farm in Bromham, following a long-running dispute over the unauthorised dumping of waste and residential caravan use on the site.
The original notice, issued on 18th February 2025, required the landowner to stop importing and depositing waste, clear the land of stored waste and items, and cease the use of the site for residential caravans. The farm had initially been given until 25th March 2025 to comply, with clearance to be completed within 18 months.
At the time, Cllr Nick Botterill said the council had “no choice” but to take enforcement action, describing it as a “last resort” after the owners failed to voluntarily comply with planning regulations.
However, the owner and occupiers appealed the notice. On 1st October 2025, that appeal was dismissed, and the notice has now been upheld in full.
As a result, the freeholder and leaseholder of Wyatts Lake Farm must now:

Stop the importation and deposit of waste within one month from 1 October 2025.

Cease open storage of waste within 18 months.

End general storage use within 12 months.

Remove all residential caravans within six months.
Failure to meet these requirements could result in the council seeking a High Court injunction or criminal prosecution for non-compliance.
Cllr Adrian Foster, Cabinet Member for Strategic Planning, Development Management and Housing, welcomed the appeal decision.“It is good news that this appeal was rejected and the owners and occupiers of Wyatts Lake Farm must now abide by the Enforcement Notice,” he said.
“Throughout this process, our Planning Officers have made every effort to work constructively with the owner and occupiers, but they have continued to breach planning regulations by storing waste and hosting unauthorised residential caravans on the site. We will now be monitoring compliance and will take appropriate action if the requirements are not met.”
The council said it remains committed to tackling unauthorised land use and protecting Wiltshire’s environment and communities through firm but fair enforcement of planning laws.
